REQUEST FOR RELEASE OF FUNDS

On or about 8/25/2022 the City of Olton will submit a request to the Texas Department of Agriculture for the release of Community Development Block Grant Program funds under Section 104 of Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as Olton CDV21-0105 - waterline - EA #CDV21-0105 for the purpose of replacing undersized and dilapidated water line in order to ensure customers have adequate water service for an estimated cost of $350,000 in HUD funds : and $35,000 in Non-HUD funds.

Description of Aggregated Project

 5th, 4th & G Neighborhood - 03J
Install approximately three thousand six hundred linear feet (3,600 l.f.) of six-inch (6in.) water line including boring and line reconnections, fire hydrants, valves, related pavement repair, and all associated appurtenances.

 5th, 4th & G Yard Lines - 14A
Abandon existing water lines, transfer water service and replace yard lines to 27 households. In
addition 2 non-LMI households will receive yard line replacement and are not included in the
beneficiary figures below. TxCDBG funds shall not fund a yard service line on private property to a household that does not qualify as LMI.

●       Mobilization, 1 LS

●       6" Water Line, 3600 LF

●       6" Valve, 18 Each

●       Fire Hydrant w/ Valve, 3 Each

●       Service reconnections, 29 Each

●       Metal Tape, 3600 LF

●       Slick Bore, 100 LF

●       Pavement Repair, 200 SY

 Professional Services including Grant Administrator and Project Engineer activities.

LOCATION:

All work will occur in the City of Olton, Lamb County, Texas in the following locations:

5th, 4th & G Neighborhood - 03J and 5th, 4th & G Yard Lines - 14A

●       2nd Street - from Main Street west to center of block, then south to 5th Street then east to Main Street

●       Ave H from 4th Street south to center of block

●       Ave I from Alley between 5th and 6th north to center of block then east to Ave G then south to 5th Street. 

 FINDING OF NO SIGNIFICANT IMPACT
 The City of Olton has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file 900 Main St.  Olton, TX 79064 and may be examined or copied weekdays at Thursdays: 8:00am -12:30pm and 1:30pm - 5:00pm.

PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the Olton City Hall at citysecretary@cityofolton.com.  All comments received by 8/24/2022 will be considered by the City of Olton prior to authorizing submission of a request for release of funds.

Comments should specify which Notice they are addressing.

 ENVIRONMENTAL CERTIFICATION
 The City of Olton certifies to the State of Texas that Keeley Adams in their capacity as City Administrator consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  The State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Olton to use Program funds.
 
OBJECTIONS TO RELEASE OF FUNDS
 The State will accept objections to its release of fund and the City of Olton’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Olton (b) the City of Olton has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Texas Department of Agriculture at CDBG_EnvReview@TexasAgriculture.gov or PO Box 12847, Austin, Texas 78711.  Potential objectors should contact the State to verify the actual last day of the objection period.
